Terms of Service

Welcome to Stance. These Terms of Service ("Terms") govern your access to and use of the Stance mobile application (the "App") operated by Agentic Studio ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

2. Description of Service

Stance is an AI-powered mobile application that enables users to create AI-generated photos and videos by:

  • Uploading photos from your device.
  • Applying AI-powered effects, style transfers, and artistic transformations to photos.
  • Generating AI videos from still images.
  • Saving, exporting, and sharing your creations.

3. User Content and Uploads

3.1 Your Content

You retain ownership of any photos, images, and other content you upload or create within the App ("User Content"). By uploading User Content, you grant us a limited, non-exclusive, royalty-free license to process your content solely for the purpose of providing the App's services (AI photo transformation, video generation, and style transfer).

3.2 Content Requirements

You represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to upload and use your User Content.
  • You have obtained consent from any identifiable individuals in photos you upload.
  • Your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party.

3.3 Restrictions on Uploaded Content

You agree not to upload content that:

  • Contains unauthorized likenesses of celebrities, public figures, or other individuals without their consent.
  • Is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
  • Promotes discrimination, hatred, or violence against any individual or group.
  • Contains sexually explicit material involving minors.
  • Infringes any patent, trademark, copyright, or other proprietary rights.

4. AI-Generated Content

4.1 Ownership of Generated Content

Photos, videos, and artwork generated through the App using your inputs are provided to you for your use. The specific rights depend on your subscription tier:

  • Free Users: You may use generated content for personal, non-commercial purposes.
  • Premium Subscribers: You receive expanded usage rights, including commercial use of generated content, subject to the terms of your subscription plan.

4.2 AI Limitations

You acknowledge that:

  • AI-generated content may contain inaccuracies, artifacts, or unexpected results.
  • We do not guarantee that generated content will be free from errors or suitable for any particular purpose.
  • Generated content may occasionally resemble existing copyrighted works unintentionally. You are responsible for ensuring your use of generated content does not infringe third-party rights.
  • We reserve the right to refuse generation requests that violate these Terms or our content policies.

5. Face Data

When you use the App to process photos containing faces, face data may be temporarily processed by our AI systems. You acknowledge and agree that:

  • Face data is used solely for the purpose of providing photo and video generation services.
  • Face data is NOT retained after processing. Temporary caches are automatically deleted within 24-48 hours.
  • Face data is NOT used for facial recognition, identification, or any purpose beyond your requested generation tasks.
  • We do NOT sell, share, or disclose face data to third parties except as required to process your generation requests through our cloud infrastructure providers.

6. Prohibited Uses

You agree not to use the App to:

  • Generate content that is illegal, harmful, or violates the rights of others.
  • Create deepfakes, misleading content, or content intended to deceive others about its AI-generated nature.
  • Harass, bully, or intimidate any individual through generated content.
  • Reverse engineer, decompile, or attempt to extract the source code or AI models used by the App.
  • Use automated systems, bots, or scripts to access or interact with the App.
  • Circumvent any rate limits, usage restrictions, or security measures.
  • Resell, sublicense, or commercially redistribute the App or its underlying technology.

7. Intellectual Property

The App, including its design, code, AI models, user interface, and branding, is the intellectual property of Agentic Studio and is protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

8. Subscriptions and Payments

  • Subscription terms, pricing, and billing cycles are clearly communicated before purchase within the App.
  • Payments are processed through the Apple App Store, subject to Apple's terms and conditions.
  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current billing period.
  • You may cancel your subscription at any time through your device settings. You will retain access through the end of the current billing period.
  • Refunds are subject to the policies of the Apple App Store.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AGENTIC STUDIO AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Agentic Studio and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the App, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease. You may delete the App and all associated data at any time through the App's Settings or by uninstalling.

13. Additional Terms for iOS Devices

If you access the App through a device made by Apple, Inc. ("Apple"), you acknowledge:

  • These Terms are between you and Agentic Studio, not Apple. Agentic Studio is solely responsible for the App and its content.
  • Apple has no obligation to furnish any maintenance or support services with respect to the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. Apple will have no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App.
  • Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and Apple will have the right to enforce these Terms against you.

14. Transfer and Processing of Data

By using the App, you consent to the transfer and processing of your data in the United States and other countries where our service providers operate. We use commercially reasonable measures to protect your data during transfer.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing notice within the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Agentic Studio operates, without regard to its conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
